Title Insurance
Title Insurance is available for foreign buyers of Mexican property. This ensures that you will be covered for any losses you may incur if your property’s title turns out to have been misrepresented to you when you purchased the property (for instance, if the seller didn’t really fully own the title to begin with, or if there is a lien or encumbrance on the property that isn’t disclosed during the title search). Typically, title insurance will cost $3,000. The actual cost will be determined based on your property.
You may purchase title insurance from a Mexican company, or you may also purchase American title insurance, which will be enforceable in the United States against an American company. The buyer should have a title search and examination done before the property is purchased; if you purchase title insurance, you will then be protected in the event of undisclosed liens, and other problems with the title that don’t appear during the title search. Title insurance usually does not cover certain problems, which may include but are not limited to: defects, liens or encumbrances that are known to the claimant (though not a matter of public record), or are created after the date of the policy, or that were created or agreed to by the claimant. Please note the preceding two paragraphs are provided as a general guideline only, and that only your title insurance policy will detail the exact, legally binding provisions of such exclusions.
